General Terms and Conditions of Sale

Article 1 - Fields of application

Any sale or reservation contracted electronically with our Group is subject to these General Terms and Conditions.

Electronic means may be used to make available contractual conditions or information on goods or services in application of article 1369-1 of the Civil Code.

Information requested for the purpose of concluding a contract or sent during its execution may be transmitted if the recipient has agreed to the use of this means.

Article 3 - Consumer information

The essential characteristics of our stays and accommodation offers sold electronically are available in application of article L 111-1 of the Consumer Code on the site www.contact-hotel.com.

Our prices are displayed according to the Customer's search criteria. In addition to the total price of the reservation mentioned, the telecommunications costs inherent to accessing the site remain the responsibility of the customer.

These T&Cs can be viewed in French and English. They can be printed by following the instructions on the site.

Article 4 - Conditions of validity and withdrawal

The conditions of validity of our offers of stay or accommodation and prices are determined by the updating of the site with each search by the customer and by the release of our offers or promotions. They remain applicable as long as they remain accessible by us, in application of article 1369-4 of the Civil Code.

Non-changeable, non-cancellable offers: hoteliers may be required to make promotional offers for which no cancellation or modification is possible.

In any event, pursuant to Article L221-5 of the Consumer Code, the right of withdrawal is not applicable for the provision of accommodation services, this being mentioned in the article: L221-25.

Article 5 - Steps of the reservation

All reservations follow these steps:

  1. The customer indicates the criteria for his request.
  2. Contact Hôtel, through its website, offers one or more offers.
  3. After the Customer's choice, the order summary is displayed (details and total price).
  4. After verification, the Customer definitively validates his order after having validated these General Terms and Conditions.
  5. The Customer enters, on the secure interface, the sixteen-digit number and the expiry date appearing on the front of his bank card, as well as, where applicable, the numbers of the visual cryptogram appearing on the back of his bank card. Depending on the conditions applied by certain hotels, and according to certain promotional offers, the Customer's card may be debited for the amount due. By communicating his bank card number and the above-mentioned information, the customer authorizes the debit notwithstanding the absence of a written agreement within the meaning of Article 1341 of the Civil Code.
  6. The Customer receives within a maximum of one hour a detailed confirmation of his order at the email address he has provided. The reserved stay is definitively acquired by the Customer only after receipt of the confirmation (or the actual debit of his bank card according to the conditions applied by certain hotels and according to certain promotional offers).
  7. With each reservation, a reservation number is issued, which will allow the Customer to cancel the reservation if necessary (please note, in the event of online payment and depending on the promotional offer, no cancellation, modification or refund will be possible).

Article 6 - Price, Invoice

Our prices are in Euros and all taxes included. Payment is made directly to the hotelier, the Customer has the possibility to ask for an invoice corresponding to his stay.

Article 7 - Bank details

Our partner D-Edge is the only one, through its secure space, to have knowledge and to keep the Client's banking information. This information does not pass through the Contact Hôtel website in any way.

It is recalled that the Customer has a period of 70 (seventy) days, which can be extended to 120 (one hundred and twenty) days depending on the bank, to object to the use of his bank card, in the event of loss, theft or fraudulent use in application of article L 132-6 of the Monetary and Financial Code. 

In the event that, for any reason whatsoever, the debit of sums owed by the Customer proves impossible, the sale made will be immediately resolved by operation of law and the electronic purchase process cancelled.

We draw your attention to the fact that the hotels are operated by companies legally independent of the Contact Hotel Association.

Article 9 - The Loyalty Program

Membership in the Cash & Smile loyalty program is possible free of charge on www.contact-hotel.com or in the member hotels of our Group. The loyalty account is strictly personal and may not under any circumstances be transferred or sold to anyone or used for purposes other than those defined by Contact Hôtel in the General Conditions of Use (CGU) of the loyalty program.

Article 10: Electronic files - Protection of privacy

Contact Hôtel has created an electronic file which records certain personal data relating to its Customers. When an order is placed on the site www.contact-hotel.com by any new customer, this database is enriched with information concerning them, which will subsequently allow us to better meet their expectations and facilitate the assistance services provided by the Contact Hôtel Customer Service. This database has been declared, in accordance with the requirements of the law relating to Information Technology, Files and Liberties of 6 January 1978, amended by the law of 6 August 2004.

The information on the online registration form, followed by an asterisk, is mandatory. Membership cannot be taken into account if these mandatory information have not been completed.
